The national deputy of the PRO Graciela Ocaña presented a precautionary measure before the Justice with the aim of preventing Vice President Cristina Kirchner from charging a retroactive millionaire for her double pension, as the widow of former President Néstor Kirchner and for having been head of the Executive. The retroactive figure amounts to about $176 million.
Ocaña asked the Justice to issue a precautionary measure "urgently ordering ANSES to refrain from paying an illegal retroactive amount", which warned that "it would imply the consummation of the crime of embezzlement of public funds duly denounced", according to the presentation to which TN agreed.

The Juntos por el Cambio deputy warned that “the Executive Director of ANSES Fernanda Raverta illegally withdrew, with the manifest purpose of harming the state coffers for the benefit of its public and notorious political leader, of the appeal that the organization itself had presented against the judgment of the first instance judge.
Ocaña mentioned that "the conduct of the Executive Director of ANSES is contrary to the law" and that she could incur in "the possible commission of the crimes typified in articles 248 and 260 of the Penal Code." These are the crimes of "abuse of authority and violation of the duties of public officials" and "embezzlement of public funds."

Ocaña cited an ANSES resolution that "establishes that the payment of the retroactive payments that may correspond are suspended," when requesting a precautionary measure to disqualify Cristina Kirchner from collecting a millionaire retroactive payment for a double pension.
