Salary increase for public workers from January 1, 2023: This is all that is known

By provision of the Ministry of Economy and Finance (MEF), from January 1, the Salary increase for servers, managers and officials of the regimes of legislative decrees 728 and 1057, as well as laws 30057, 29709 will enter into force. and 28091.

The institution published today, December 25, Supreme Decree 311-2022 in the newspaper El Peruano and made official the measure that will be beneficial for employees of the Peruvian State apparatus.

The opinion indicates that the public sector Budget Law for the Fiscal Year 2023 authorizes the MEF to approve the monthly increase of the servers of the regimes of the aforementioned legislative decrees and laws, agreed in a clause of the Centralized Collective Agreement 2022 -2023.

In this way, the monthly increase approved for the following servers, managers and officials of the aforementioned regimes is set:

-Legislative Decree No. 728: 51.11 soles

-Legislative Decree No. 1057 (CAS): 64.19 soles

-Law No. 30057, Civil Service Law: 52.21 soles

-Law No. 29709, Law of the Special Public Penitentiary Career: 55.67 soles

-Law No. 28091, Law of the Diplomatic Service of the Republic: 55.67 soles

The rule also notes that if the total monthly income, which includes the increase approved in the preceding table, exceeds the amount of 15,600 soles, the monthly increase will be adjusted to said limit.

In addition, it is provided that the monthly increase approved in this regulation has a remunerative nature, is of a pensionable nature, is subject to social charges and constitutes the calculation basis for the corresponding labor benefits.

It is determined that for the granting of the monthly increase, the following conditions are observed:

a) In the entities of the National Government and in the regional governments, the beneficiary servants must be registered in the Computer Application for the Centralized Registry of Payrolls and Data of the Human Resources of the public sector (Airhsp) of the MEF.

b) The total monthly income of the server must not exceed the amount of 15,600 soles, in accordance with article 2 of emergency decree 038-2006.

In addition, it is dictated that the monthly increase of the servers, managers and officials of the regimes of DL 728 and 1057, as well as Laws 30057, 29709 and 28091, provided in this supreme decree constitutes an independent concept to the income that receive and is incorporated into the payroll.

It is provided that in the case of entities of the National Government and regional governments, the General Directorate of Fiscal Management of Human Resources of the MEF proceeds ex officio to the registration of the monthly increases, approved in this regulation, in the Airhsp.

It is established that the financing of what is established in this supreme decree is charged to the institutional budget of the respective entities.

"In the case of public entities referred to in Article 72 of Legislative Decree 1440, regulation of the National Public Budget System, municipalities and decentralized public agencies of regional and local governments, if applicable, the expenditure that The implementation of the provisions of this decree is financed from their respective institutional budgets, without demanding additional resources from the Public Treasury", reads the text of the opinion.
