Co-participation: the UCR will continue with the impeachment complaint against Alberto Fernández

Despite the fact that the Government had stated that it was not going to abide by the Supreme Court ruling, President Alberto Fernández assured this Monday that he will pay the funds from the City's co-participation with public titles.

In this context, the opposition was divided regarding the resolution taken by the President. The first to come out to reject the decision was Horacio Rodríguez Larreta, who stressed the "non-compliance with the ruling" by the ruling party.

Opposition leaders considered it a victory that the Government has to "go back" with its initial position and assured that they will file the complaint for "sedition", however, they confirmed the request for impeachment against the President will continue.

In Solo Una Vuelta Más (TN), the president of the PRO Patricia Bullrich highlighted the "political defeat that Kirchnerism had from the moment the ruling came out until now for having to retract everything they had said."

"They realized that they had no social support and the opposition acted quickly," he said, adding: "I understand that the acceptance of the Government is the triumph of the Republic over autocracy."

Earlier he had tweeted: “We won! The Government could not break the rule of law in Argentina”. Bullrich remarked that they will suspend the presentation of the complaint for sedition "while they remain within the constitutional State" because they await the response of the Supreme Court in relation to the actions of the Government.

Sources from the Civic Coalition, for their part, confirmed to TN that they are not going to withdraw the complaint: "The crime of uprising is configured because they made legal excuses for not complying with the ruling."

“The complaint for a crime of public order cannot be withdrawn and does not correspond because these actions must be criminally investigated. After the Court communicated the ruling, the President met with the governors to find devices such as this 'in extremis replacement' to not comply with the precautionary measure”, they affirmed.

Hours after Alberto Fernández communicated the payment of the funds through the networks, the Buenos Aires government spoke out against it and rejected the decision: "It continues to disrespect the institutions."

The Minister of Government, Jorge Macri, ruled along the same lines: “The sentences are not discussed, they are complied with and the Court ordered the return of the funds. But as always the President does everything by halves. Paying with a 90-day bond is to continue hurting people. Rule seriously."

Meanwhile, deputy María Eugenia Vidal tweeted: “Pay as ordered by the Supreme Court, not with bonds. Stop cheating." “For CABA, bonds. To Kicillof 'cash'. For CABA, unnecessarily modify the Law. For Kicillof, discretionary management of the Budget. Alberto Fernández responds with Cristina Kirchner's pencil, he could never stop responding to her orders ”, criticized the UCR senator, Alfredo Cornejo.

The president of the UCR block, Mario Negri, questioned the delivery of public securities as payment of the funds: "The TX31 bond with which Alberto Fernández wants to pay CABA is a pagadios that is not listed on the market and is not negotiated ”.

The UCR confirmed to TN that the block is analyzing "how everything evolves" before sending the formal request for impeachment to Congress.

“The block had signed the request for impeachment by the 33 deputies, based on the fact that the Government had said that it would not abide by the Supreme Court ruling. But the President's announcement changed the facts, so now the block is analyzing how everything evolves. The intention is to leave the impeachment request on hold for a few days, but under no circumstances will it be archived," explained radicalismo sources.

On the other hand, the libertarian deputy José Luis Espert presented this Monday a project "that promotes the Political Trial against the President of the Nation for poor performance and for the commission of possible crimes in the exercise of his functions"

“The actions of Alberto Fernández in the exercise of the Presidency of the Nation with his contempt for the ruling of the Supreme Court of Justice attacks the republican system established by the Constitution. What he is ultimately doing is using the power of the State to attack the republican system, since he uses his position of power allied with a group of governors sympathetic to his government to challenge the power of the Supreme Court of Justice”, says the initiative.

After several meetings at the Buenos Aires headquarters on Uspallata street, Horacio Rodríguez Larreta rejected the payment in bonds and resolved that the City Attorney demand that "the necessary means be arbitrated" to comply with the resolution.

"The Executive Branch continues to fail to comply with the ruling of the Supreme Court of Justice by not complying with what was ordered by the highest court in its response to the precautionary measure presented by the City Government," says the document that the Buenos Aires government presented before the Supreme Court.

His argument notes that "the resources of the co-participation must be transferred daily and cannot be discretionally replaced by another form of financing."

Likewise, the letter states: "As established by republican norms in a country with a division of powers, the rulings are complied with, not interpreted."

The president, Alberto Fernández, announced on Twitter that he will pay with bonds the return of the co-participation to the city of Buenos Aires, after the ruling of the Supreme Court. He clarified that it will be "the money corresponding to 90 days of validity of the precautionary measure, pending the final ruling, or a law of Congress that assigns the relevant budgetary resources to this payment."

Alberto Fernández said that he instructed the Chief of Staff, led by Juan Manzur, "to reallocate the only resources available for the year 2022 and transfer them to a Banco Nación account in the name of the GCBA."

In this way, the President reversed his initial position of non-compliance with the sentence. Now he said on Twitter that "judicial decisions are mandatory even when I deem them disvaluable and unfair": "Respectful of the rule of law, I will seek to reverse the bad resolution of the CSJN and return to the path of federalism, observing and enforcing the Constitution as I have sworn to do ”.

Alberto Fernández mentioned as antecedent the payment of a debt to Santa Fe with titles: "The consigned bonds have already been accepted by the CSJN to meet the debt of the National State with the Province of Santa Fe. Thus, there would be no injury to the right granted to the CABA, unless the court believes that there are first class cities and second class provinces”.
